Loyalty Scheme Terms and Conditions

Terms and conditions for our loyalty programme, through which you can earn points and gain a range of perks

 

  1. Introduction

These Terms and Conditions govern the loyalty scheme operated by The Inn Collection Group.

When you apply for membership through our dedicated mobile app, we will ask for your express agreement to these Terms and Conditions.

These Terms and Conditions, along with our other applicable legal documents, will form a legally binding contract between you and us.

  1. How to join

To become a member, you must:

  • download our The Inn Collection Group app
  • create an account using the app, providing a valid email address in the process; and
  • confirm your acceptance of these Terms and Conditions.

Membership is free and personal to you.

You cannot transfer your membership, account or any loyalty scheme perks to anyone else.

  1. Earning points

You may earn loyalty points when you:

  • book and stay at one of our inns;
  • purchase food or drinks or services from us; or
  • participate in promotional activities we may offer.

Points are awarded after you complete your stay or purchase. Points will not be awarded with respect to a booking if a different person stays with us under that booking.

We may take up to 30 days to add points to your account.

  1. Membership tiers and perks

Your membership tier depends on the total points earned in the previous 12 months. We offer progressive tiers with increasing perks.

Available perks may include:

  • complimentary food, drinks and other goods;
  • discounts on accommodation and services;
  • invitations to exclusive events;
  • access to member-only offers and promotions;
  • priority booking privileges;
  • room upgrades (subject to availability); and
  • extended check-out times.

Perk conditions:

  • we reserve the right to change the perks available at any time by giving you notice through the app or email;
  • perks cannot be exchanged for cash;
  • perks are subject to availability and may have expiry dates or restrictions;
  • you must verify your membership (via the app) when claiming perks;
  • some perks (such as alcoholic drinks) will be subject to age restrictions; and
  • perks are non-transferable and, unless specified otherwise, for your personal use only.
  1. Your responsibilities

You are responsible for:

  • keeping your membership and account information current and accurate;
  • protecting your login credentials and account security;
  • notifying us immediately of any unauthorised use or security breaches; and
  • using the loyalty scheme in accordance with these Terms and Conditions.
  1. Suspension and cancellation of membership

You may cancel your loyalty scheme membership at any time by contacting and requesting cancellation.

Your membership may be cancelled if no points are earned and no perks are claimed for a period of 3 years.

We may suspend or cancel your membership and/or account if you:

Upon cancellation of your membership, all unused points and unredeemed perks will be forfeited.

  1. Limitations and exclusions of liability

Nothing in these Terms and Conditions will:

  • limit or exclude any liability for death or personal injury resulting from negligence;
  • limit or exclude any liability for fraud or fraudulent misrepresentation;
  • limit any liabilities in any way that is not permitted under applicable law; or
  • exclude any liabilities that may not be excluded under applicable law.

Subject to the above, we limit out liability as follows:

  • the limitations and exclusions of liability set out in these Terms and Conditions govern all liabilities arising under these Terms and Conditions or relating to the use of our loyalty scheme, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty;
  • we will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control;
  • we will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill; and
  • we will not be liable to you in respect of any special, indirect or consequential loss or damage.

We will not be liable to you in respect of any unavailability of our booking systems.

  1. Data protection and privacy

We process your personal data in accordance with our Privacy Policy and applicable data protection laws.

When you join the scheme, we will ask for your consent to our sending you marketing communications related to the scheme (which you may opt out of at any time).

  1. Changes to Terms and Conditions and scheme

We may revise these Terms and Conditions, and/or loyalty scheme structures and perks, by providing advance notice through:

  • email and in-app notification; and/or
  • publishing changes on our website.

Material changes that negatively affect existing members may include transitional provisions to protect accrued perks.

If you disagree with any changes, you should contact us to cancel your membership.

  1. General provisions

Your statutory consumer rights are not affected by these Terms and Conditions.

We may assign, transfer, or subcontract our rights and obligations under these Terms and Conditions. You may not assign your membership to another person without our written consent.

If any provision of these Terms and Conditions is deemed unlawful or unenforceable, the remaining provisions will continue in effect.

These Terms and Conditions, together with any specific promotional terms, constitute the entire agreement regarding the loyalty scheme.

These Terms and Conditions are for your benefit and yours only and are not intended to benefit any third party.

These Terms and Conditions are governed by English law. Disputes will be subject to the exclusive jurisdiction of English courts, though consumers may also bring proceedings in their country of residence.
