Gift Voucher Terms and Conditions

 

  1. Introduction

These Terms and Conditions apply to all gift vouchers issued by The Inn Collection Group.

These Terms and Conditions apply with respect to both purchasers and recipients of gift vouchers:

  • by buying a gift voucher, you agree to these Terms and Conditions, in which case the contract under these Terms and Conditions is made when we accept your order and payment; and
  • by using a gift voucher, you agree to these Terms and Conditions, in which case the contract under these Terms and Conditions is made when you first make a booking using the gift voucher.

In each case, these Terms and Conditions will form a legally binding contract between you and us.

  1. Types of gift vouchers

We offer two types of gift vouchers:

  • package vouchers – for specific accommodation and/or meal packages; and
  • monetary vouchers – for a cash amount that can be spent on accommodation, meals, or other services at our inns.

Our gift vouchers are available in both print and digital forms.

  1. Purchasing gift vouchers

You can purchase gift vouchers:

  • online, through our website;
  • by telephone, through our reservations team; or
  • at reception desks at any of our inns.

Payment must be made in full at the time of purchase using any accepted payment method.

All prices are inclusive of VAT where applicable. For package vouchers, VAT is charged at the time of purchase. For monetary vouchers, VAT is charged when the voucher is redeemed.

  1. Cancellation rights

This section of these Terms and Conditions applies if and only if you purchase a gift voucher from us as a consumer and via our website or by telephone – that is, as an individual acting wholly or mainly outside your trade, business, craft or profession.

You may cancel a contract under these Terms and Conditions at any time before the end of the period of 14 days after the day upon which you purchase the gift voucher(s) under the contract. You do not have to give any reason for your withdrawal or cancellation.

The right to cancel ends immediately if the voucher is used, including partial use in the case of a monetary voucher.

In order to cancel a contract on the basis described in this section, you must inform us of your decision to cancel. You may inform us by means of any clear statement setting out the decision. You may inform us using the cancellation form that we will make available to you on our website at URL. To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right to cancel before the cancellation period has expired.

If you cancel a contract, on the basis described in this section, you will receive a full refund of any amount you paid to us in respect of the contract. We will refund money using the same method used to make the payment, unless we and you have expressly agreed otherwise. In any case, you will not incur any fees as a result of the refund. We will process any refund due to you without undue delay and, in any case, within the period of 14 days after the day on which we are informed of the cancellation.

  1. Other refunds and replacements

Gift vouchers cannot be refunded except as required by law (including as detailed above).

Lost or stolen gift vouchers cannot be replaced unless you can provide proof of purchase and the voucher has not been used by a third party. We maintain records of voucher purchases and usage to assist with verification, but we cannot guarantee replacement in all circumstances.

  1. Validity periods

Gift vouchers are valid for 12 months from the date of purchase, unless a different period is printed on or specified in the voucher.

Expired vouchers will not be accepted, and any remaining balance will be forfeited.

We cannot extend the validity period of vouchers once issued.

  1. Using your gift voucher

Gift vouchers can only be used at our inns for the services specified on the voucher, and only for direct bookings.  Accordingly, you may not use a voucher when making a booking via a third party booking service.

All services are subject to availability. Please contact our customer service team ahead of using your voucher to make sure you can access the chosen service at the chosen facility, at the chosen time.

For accommodation and meals, some dates may be excluded (e.g. Christmas or other special dates/events).

For package vouchers, advance booking is essential and subject to availability. We recommend booking accommodation and meals at least 14 days in advance, and earlier during peak periods.

When making a booking using a gift voucher, you must quote the voucher number and bring the physical voucher or electronic confirmation at the time of arrival.

With respect to monetary vouchers:

  • if your purchase costs less than the voucher value or the remained voucher value (if it was partially used), no change or credit will be given; and
  • if your purchase costs more than the voucher value, you must pay the difference using another accepted payment method.

Additional charges may apply for premium room categories or additional services.

Gift vouchers are non-transferable except where the original purchaser chooses to give the voucher as a gift.  For the avoidance of doubt, you must not resell gift vouchers.

Gift vouchers may not be exchanged for cash (except as required by law), used to purchase other gift vouchers, combined with other gift vouchers, or combined with other promotional offers (unless we expressly state otherwise on the voucher).

Free or promotional vouchers (such as charity raffle prizes) may have additional restrictions, which will be stated on the voucher.

  1. Limitations and exclusions of liability

Nothing in these Terms and Conditions will:

  • limit or exclude any liability for death or personal injury resulting from negligence;
  • limit or exclude any liability for fraud or fraudulent misrepresentation;
  • limit any liabilities in any way that is not permitted under applicable law; or
  • exclude any liabilities that may not be excluded under applicable law.

Subject to the foregoing, the limitations and exclusions of liability set out in these Terms and Conditions govern all liabilities arising under these Terms and Conditions or relating to the use of our gift vouchers, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

We will not be liable to you in respect of any special, indirect or consequential loss or damage.

Our liability to you with respect to any gift voucher or contract for a gift voucher is limited to the face value of the gift voucher.

We will not be liable to you in respect of any unavailability of our booking systems.

  1. Personal data

We will only use your personal information as set out in our Privacy Policy.

Like many websites, our website uses technology called cookies and web server logs to collect information about how the website is used and how to improve them. Further details are set out in our Cookie Policy.

  1. General

Your statutory consumer rights are not affected by these Terms and Conditions.

We process your personal data we collect in relation to gift vouchers in accordance with our Privacy Policy and applicable data protection laws.

We may revise these Terms and Conditions as published on our website from time to time. The revised Terms and Conditions shall apply to gift vouchers purchased after the date of publication of the revised Terms and Conditions on the website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these Terms and Conditions.

You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these Terms and Conditions.

If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision of these Terms and Conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Any contract under these Terms and Conditions is for our benefit and your benefit and is not intended to benefit or be enforceable by any third party. The exercise of the parties’ rights under a contract under these Terms and Conditions is not subject to the consent of any third party.

These Terms and Conditions, along with our Booking Terms and Conditions, constitute the entire agreement between you and us in relation to your purchase and use of our gift vouchers, and shall supersede all previous agreements between you and us in relation to your use of our website.

These Terms and Conditions shall be governed by and construed in accordance with English law. Any disputes relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England. If you are a consumer, you may also bring proceedings in the courts of the country where you live.
